Last week, the IRS released Notice 2011-1 exempting insured plans from the new nondiscrimination rules in the Affordable Care Act (and related penalties for non-compliance) until the IRS issues further guidance. The new notice also provides that future guidance is expected to only apply to plan years beginning after issuance. Effectively, this means that for calendar year plans, the earliest the nondiscrimination rules should apply is January 1, 2012. Compliance with the nondiscrimination rules for insured plans will be difficult.  The attached Legal Alert discuses the current state of the nondiscrimination rules for self-insured and insured plans, and provides a view through the IRS window as to how the nondiscrimination rules could apply to insured plans beginning in 2012.  PDF with detailed instructions: http://www.screencast.com/t/8spG6TgIr0
